These Terms & Conditions ("Terms") govern sales made through the online store Lume at lume-boutique.com.pl (the "Store").
1. Seller
The Store is operated by Jakub Rembiewski, conducting business under the name VIP APARTMENTS JAKUB REMBIEWSKI, ul. Młodzieżowa 31a/10, 09-100 Płońsk, Poland, registered in the Central Registration and Information on Business (CEIDG).
- NIP (Tax ID): 5671919945
- REGON: 384141119
- E-mail: lumeboutiq@gmail.com
- Phone: +48 500 401 595 (Mon–Fri, 9:00–17:00)
2. Scope & acceptance
By placing an order you confirm that you are at least 18 years old and that you have read and accept these Terms, the Privacy Policy and the Returns Policy. The Store sells new goods to consumers and to businesses.
3. Contract formation
Product listings in the Store are an invitation to conclude a contract, not a binding offer. A sales contract is concluded when we send you an order confirmation e-mail. We may decline or cancel an order — with a full refund — where an item is unavailable or where a price or description was clearly erroneous.
4. Prices & payment
All prices include Polish VAT and are shown in the currency you select at checkout (PLN or EUR). The total price, including any delivery fee, is shown before you confirm the order. Available payment methods:
- BLIK
- Przelewy24 (online bank transfer and card payments)
- Cash on delivery (payment to the courier on receipt) — available within Poland
We do not store full card numbers; online payments are handled by the payment provider.
5. Delivery
We deliver within the territory of Poland only. Available delivery methods are InPost Parcel Lockers (Paczkomaty), InPost Courier, DPD and DHL. Estimated delivery times and fees are listed on the Shipping page.
The standard order handling time is 3–5 business days; the courier's transit time is added to this. Risk of loss or damage passes to a consumer upon delivery of the goods to the consumer or a person designated by them.
6. Right of withdrawal
A consumer (and a sole trader buying for non-professional purposes) may withdraw from the contract within 14 days of receiving the goods, without giving any reason, under the Act of 30 May 2014 on Consumer Rights. To do so, send an unequivocal statement to lumeboutiq@gmail.com or use the model withdrawal form. You may also start a return from your account — see the Returns Policy.
Return the goods within 14 days of withdrawal. We refund all payments received, including the cheapest standard delivery we offer, within 14 days — we may withhold the refund until the goods are returned. The direct cost of returning the goods is borne by the consumer.
The right of withdrawal does not apply to the contracts listed in Article 38 of the Act on Consumer Rights, including goods made to the consumer's specification or clearly personalised, and sealed goods that cannot be returned for health or hygiene reasons once unsealed.
7. Complaints & conformity with the contract
We are obliged to deliver goods that conform to the contract. For consumers, we are liable for any lack of conformity under the Act on Consumer Rights. For business buyers, the statutory warranty (rękojmia) under the Civil Code applies.
File a complaint by e-mail at lumeboutiq@gmail.com, describing the defect and your request (repair, replacement, price reduction or — in the cases provided by law — withdrawal). We will respond within 14 days.
8. Reviews
Registered customers who have purchased a product may publish a review of it. Reviews must not contain unlawful content; we may remove reviews that breach these Terms or the law. We publish reviews in a way that lets other customers recognise opinions coming from verified purchasers.
9. Out-of-court dispute resolution
A consumer may use out-of-court complaint and redress procedures — among others, the permanent consumer arbitration courts and mediation run by the regional inspectorates of the Trade Inspection (Inspekcja Handlowa), and the free assistance of the municipal or district consumer ombudsman (miejski/powiatowy rzecznik konsumentów). More information is available from the Office of Competition and Consumer Protection (UOKiK) at uokik.gov.pl.
10. Governing law
These Terms are governed by Polish law. This does not deprive a consumer of the protection afforded by mandatory provisions of the law of their country of habitual residence. Matters not regulated here are governed by the Civil Code, the Act on Consumer Rights and other applicable Polish law.
